Terms of Service

These terms govern your use of Plasmiq, a service that provides AI receptionists to answer phone calls for your business. By creating an account or using the service, you agree to them.

The service

Plasmiq lets you configure an AI agent, connect it to a phone number, and have it handle inbound calls — answering questions, capturing details, booking appointments, texting callers the details, and escalating to a person when needed. AI-generated responses can be imperfect; you are responsible for reviewing your agent's configuration and monitoring its conversations.

Your account

You are responsible for your account, for the accuracy of the business information you give your agent, and for all activity under your account.

Plans, fees, and billing

Paid plans are billed in advance — monthly or quarterly, per the plan you chose when you signed up — plus any one-time setup fee and applicable taxes. Plans with included usage limits (a set number of calls or minutes per month) state those limits and any overage rate or usage-block charge up front when you sign up; usage beyond the included amount is billed at that stated rate. You can cancel any time and your plan simply won't renew — cancellation stops future charges but doesn't refund the period already paid for, except as described under Refunds below.

Fair use on unlimited plans

Unlimited plans include unlimited handling of inbound calls for the ordinary operation of one business location — that's the point of them, and normal busy seasons are exactly what they're for. They do not cover autodialed or artificially generated call traffic, operating a call center or answering service for others, reselling access, or routing multiple businesses or locations through a single agent. If usage patterns indicate that kind of abuse, we may throttle or suspend the service after notifying you.

Refunds and the 30-day guarantee

Where your offer includes our 30-day money-back guarantee: tell us within 30 days of your first charge and we'll refund it, less a usage charge at our standard per-minute rate for the calls your agent actually handled, and less any setup fee once the setup work has been delivered. Amounts prepaid for future billing periods are refunded in full if you cancel within the guarantee window. Beyond that, fees are non-refundable except where the law requires otherwise.

Acceptable use

Don't use Plasmiq for unlawful, deceptive, or harassing purposes; don't use it to place or receive calls or texts that violate telemarketing, spam, or robocall regulations; and don't attempt to disrupt or gain unauthorized access to the service.

Suspension

We may suspend or throttle service for violations of these terms, non-payment, or abuse of fair use — with notice and a chance to fix the issue wherever practical, and immediately where the violation is unlawful or puts the service or other customers at risk.

Call recording and consent

Calls handled by your agent may be recorded and transcribed. You are responsible for complying with the call-recording and consent laws that apply to you and your callers, including any notification requirements in your jurisdiction.

Availability and disclaimers

The service is provided "as is" without warranties of any kind. We work to keep it available and reliable, but we do not guarantee uninterrupted operation, and telephony depends on third-party carriers and providers outside our control.

Limitation of liability

To the maximum extent permitted by law, Plasmiq is not liable for indirect, incidental, or consequential damages, including missed calls, lost bookings, or lost profits. Our total liability for any claim is limited to the amounts you paid for the service in the three months before the claim arose.

Your responsibilities and indemnity

You're responsible for how you and your callers use your agent — including complying with the telemarketing, anti-spam, consent, and call-recording rules that apply to your business. You agree to indemnify Plasmiq against claims arising from your use of the service, the content you configure your agent with, or your failure to meet those obligations.

Governing law

These terms are governed by the laws of the Province of New Brunswick and the federal laws of Canada that apply there, and any disputes will be resolved in the courts of New Brunswick.

Changes

We may update these terms as the product evolves; material changes will be reflected on this page with an updated date. Continued use after a change means you accept the new terms.
